Vacation Rental Agreement

This Vacation Rental Agreement (“Agreement”), is for the property located at _______________, Pepe‘ekeo, Hawai‘i 96783 (“Property”) and is by and between the Jerry M. Hiatt Revocable Living Trust (“Owner”), and ___________________________________ (“Guests”, the term “Guests” expressly includes any invitees to the Property by Guests), for the rental period _________________________________ (“Reservation”). Guests acknowledge and accept that Owner must receive a signed copy of this Agreement prior to Owner’s acceptance of Guests’ arrival at the Property. The signatories to this Agreement by Guests must be 25 years or older. This Agreement also runs to the benefit of, and expressly releases, Owner’s trustee, Jerry M. Hiatt, (“Trustee”), personally, and Owner’s agent, Mahilani E.K. Hiatt (“Agent”).

I. OCCUPANCY: The Property rental is for a maximum of 10 occupants. The rental occupancy is from 3:00 p.m. on the arrival day to 10:00 a.m. on the departure day unless alternate times have been pre-arranged with Owner and confirmed in writing. All rates are quoted on a per night basis for no more than the maximum occupancy of 10 persons. Guests exceeding maximum occupancy limit will incur a $500 additional charge per guest and will be required to vacate the Property immediately. Maximum occupancy may not be exceeded regardless of the age of the Guests. All stays are subject to nightly rent, taxes, cleaning fee and security deposit.

II. GENERAL TERMS AND CONDITIONS

A. OCEAN AND OCEAN CLIFF WARNING: The Property is completely fenced but is adjacent to open ocean and to sharp lava cliffs above the open ocean. The ocean views are beautiful, but Guests are expressly warned to exercise extreme caution when walking on, or viewing the ocean from, the cliff side trail, as the rocks are sharp and sometimes can be slippery. Access to the ocean for swimming or wading from the cliffs is highly discouraged and any such ocean access by the Guests is entirely and expressly at their own risk. Walking the cliff side trail as well as ocean access and/or swimming has many inherent risks including, but not limited to: falls, cuts, bruises, sudden large waves, rip tides, or other wave or current conditions, unexpected currents, sea urchins, eels, sharks and other dangerous sea creatures (together referred to as the “Hazards”). These Hazards can vary by day, area and season. The entire risk and responsibility for the Hazards, including the risk of serious injury and/or death from the Hazards, rests solely and completely on Guests; lifeguards are not provided.

B. BEACHES: All beaches and seaside areas in Hawai‘i up to the high wash of the waves are deemed public; there are no privately owned beaches. Private property begins at the high tide mark or at the commencement of the vegetation line.

C. POOL SAFETY: The Property contains an 8-foot deep pool that does not have a separate child-proof fence surrounding it. Guests shall supervise any and all children on the Property very carefully to ensure their safety around the pool and shall keep all doors leading to the pool area locked. Use of the pool is entirely and expressly at the Guests' own risk; no lifeguard is provided.

D. GROUP EVENTS: Parties, weddings, receptions and other such functions that draw additional neighborhood traffic are not permitted at the Property. Any exception will require written permission, proof of insurance, other requirements and additional fees.

E. PHONE SERVICE: There is no landline phone service at the Property. Guests should rely on their own cellular phones.

F. TSUNAMI/HURRICANE: Much of the island of Hawai‘i is located in a tsunami inundation zone; June through November is considered hurricane season. Although the Big Island often escapes major storms, the Property is equipped with an emergency generator as a precaution and the structures are very well constructed. However, Guests do expressly assume the entire risk of occasional storms, including heavy rainfall, flooding and/or wind.

G. PEST CONTROL: In a tropical environment, even with diligent pest control, which is provided, the Property may have a modicum of pests including bugs, ants, centipedes, wasps and/or geckos (together, “Pests”). Contact with Pests inside or outside of the Property shall not constitute a basis for the termination of this Agreement, nor for the refund of any monies paid hereunder.

H. SMOKING POLICY: This property is NONSMOKING (including the lanais/patios). This rule includes E Cigarettes and Vapor Cigarettes. Violation of this policy will result in a minimum additional cleaning fee of $500 and eviction from the Property for remainder of stay. No refunds will be given.

I. FIREWORKS: Absolutely no fireworks of any kind are permitted on the Property.

J. PET POLICY: No pets are allowed on the Property. Failure to adhere to this policy will result in a minimum additional cleaning fee of $500, as well as eviction from the Property. No refunds will be given.

K. KEYS: Upon departure, please leave all keys and garage door openers on the living room table to avoid $250 fee to re-key and $75 garage door opener replacement fee.

L. WOODWORK: Many of the furniture pieces in the home are custom designed from local hardwoods. Care must be taken when placing items on, or against, the furniture, especially hot, cold or sharp items to avoid watermarks or scratches. Coasters and trivets are provided. Guests acknowledge that the only way to get rid of any watermarks and scratches is to refinish the entire surface and any cost for a refinish will be deducted from the security deposit.

M. QUIET HOURS: We value our relationship with our neighbors. Quiet Hours for the Property are 10:00 p.m. – 7:00 a.m. Failure to comply with this policy will be grounds for eviction from the Property.

N. AMENITIES: Use of any of the items that are or may be at the Property, such as the BBQ grill, the fire pit, any beach equipment, bicycles, and/or toys is entirely and expressly at the Guests’ own risk.

O. MAINTENANCE OF MAJOR/MINOR APPLIANCES: If a major appliance (refrigerator, stove/oven) becomes inoperable during your stay, Owner will promptly and reasonably attempt to resolve the issue in a timely manner. If the issue cannot be resolved, Owner will work with Guests to be compensated for any nights that the major appliance is not operable. In regards to non-major appliances (i.e., dishwasher, garbage disposal, microwave, TV, Cable, Wi-Fi, BBQ Grill, ceiling fans, etc.), Owner will promptly and reasonably attempt to resolve the issue in a timely manner. Please note that Guests may not be compensated for non-major appliances that may become inoperable during their stay.

P. GOVERNING LAW: This Agreement shall be construed and governed by the laws of the State of Hawai‘i. The exclusive venue for any action to enforce this Agreement shall be the Third Circuit Court of the State of Hawai‘i.

IV. INDEMNIFICATION & COMPLETE RELEASE OF LIABILITY
Guests understand, acknowledge and expressly accept that Owner, Trustee and/or Agent are not responsible for loss, damage or theft of Guests’ personal property and that Guests bear the financial responsibility for any loss, damage or theft of guests’ personal property and for any damages caused to the Property, or any illness injury or death to the Guests during their stay, whether caused by negligent, or malicious conduct, or by any act or omission of the Owner, Trustee and/or Agent, or Guests.

Guests expressly acknowledge and agree that Owner, Trustee and/or Agent shall not be held liable for any loss, expense, damage, or any claim for injury or death to any Guests, whether arising from claims of negligence, failure, or deficient notice, or warning as to known or unknown hazards, breach of contract, or under any other available theory, either at law, or in equity. This expressly includes but is not limited to the failure to comply with any standard, or any Federal, State, County or other statute, law, rule, ordinance or regulation.

In the event Guests breach these provisions, including by making any claim in violation of these provisions, Guests shall defend and indemnify Owner, Trustee and/or Agent from all cost and expenses incurred by Owner, Trustee and/or Agent including Owner’s, Trustee’s and/or Agent’s reasonable attorneys’ fees and costs.

V. ACKNOWLEDGEMENT: The undersigned hereby apply for rental of the Property and warrant that they have fully and carefully read this Agreement and that they understand and agree to the terms and conditions of this Agreement. Guests further understand and agree that the Owner’s offer to rent the Property is conditioned upon Guests’ acceptance of this Agreement. This Agreement may be executed in counterparts and/or by facsimile and any set of copies so executed shall be deemed sufficient proof of the Agreement. THIS IS A LEGAL DOCUMENT AND SHOULD BE READ CAREFULLY PRIOR TO SIGNING.

IN WITNESS WHEREOF, and intending to be legally bound hereby, each of the parties hereby executes the foregoing Agreement on of the dates set forth below.
